Terms and Conditions
For all deliveries and services, as well as repair and service work, apply exclusively our terms and conditions. Deviating terms and conditions of client do not undertake, even if we do not contradict them. We accept conditions of purchase only when we agree in writing.
Liability of Prices
All prices in catalogs, brochures and offers are subject to change. They are not binding until they are confirmed. All prices are net prices in € (EUR) and are only valid in conjunction with our delivery from the factory in Kirchheim. Packaging costs are not charged. If no fixed prices have been agreed, the latest catalogue price (http://www.bohnenstingl.de/en/bohnenstingl-katalog/) is valid. For price changes due to significantly higher material and purchasing costs, we reserve the right to express.
Terms of Payment
Unless other payment terms have been agreed, customers are supplied exclusively after payment in advance. For the payment in advance we offer a 3 % discount. All ordered goods will be shipped after payment received or received valid confirmation of bank transfer.
In case of exceeding other agreed payment terms, we reserve the right to charge the additional costs (interest, collection fees, court costs). On all goods delivered, we reserve ourselves the property until the full payment. This also applies to the extended reservation of title. If the buyer defaults of payment, every right to the goods delivered expires. Special production and services are not discountable.
Quantity Discount
With simultaneous ordering larger quantities, the granting of a quantity discount is possible. It must be agreed specifically for each order.
Delivery Terms
Valid delivery term is DAP (“Delivered At Place”) (customs and taxes unpaid) to the place of destination agreed upon conclusion of the contract (“Incoterms 2010 ®”).
Transportation Charges
Shipments are delivered with our appointed parcel service. Other delivery is possible by arrangement. The freight costs incurred by us are presented by us and billed with the goods. Packaging costs will not be charged.
For deliveries to countries outside the EU, in particular two cases may occur:
- Value of goods under 1000 €: Shipping costs are determined by recipient country and package weight. They will be charged to the invoice recipient with the goods.
- Value of goods over 1000 €: In addition to the shipping costs, a customs declaration fee of 30 € will be charged, which will be shown on the proforma invoice / order confirmation.
Delivery Times / Order Confirmations
The delivery takes place usually within a week. Longer delivery times will be confirmed. Partial deliveries are possible by appointment. Customs clearance may possibly lead to longer delivery times when shipping to countries outside the EU.
Retention of Title
The goods delivered by us remain property of Bohnenstingl GmbH until full payment of all claims. The purchaser agrees with his behalf, to insure the goods delivered under retention of title against the usual risks. The buyer is entitled to process the goods supplied by us or to resell. In both cases, the extended retention of title applies to the order of the goods as accepted.
Default of Payment
For all of our deliveries only our payment terms are valid expressly. If the customer is in arrears, we are entitled, in addition to overdue fines at market rates interest at the rate of eight percentage points above the benchmark interest rate to charge. The requirement of additional, verifiable delay damages is expressly reserved. If the customer is with more than 10% of the total outstanding debt in default with us, we may declare all amounts immediately.
Delay in Delivery
The quoted delivery times may be exceeded appropriate for operational reasons e.g. in case of non-stocked goods. Delays we share with you directly. For delays that are not caused by us or those based on force majeure, we cannot be held responsible.
Warranty
We grant a limited warranty period of 6 months for all our products. This warranty does not cover damage or defects caused by transportation. All claims for transport damage or defects must be made within 10 days after receipt of the goods at the forwarder.
Return of goods
Returned goods supplied by us demand our expressly approval and occur by a pickup initiated by us. Bohnenstingl GmbH bears the cost of redelivery if the return occurs because of faulty goods. In all other cases, the customer has to borne the cost for the return delivery. Special designs are not returnable.
Drawings and Descriptions of the Products
The information contained in our catalogs and brochures or other documents specified dimensions and descriptions are only approximately binding. Changes and technical improvements, we reserve explicitly. Illustrations are completed to a better understanding of the delivery..
Complaints
Obvious defects are to be notified to us immediately, or at the latest within one week of receipt of the goods and an exact description of the complaint. The customer is obliged to fully examine the goods immediately after the adoption of low quality. Later complaints can only be considered if the deficiencies in the arrival goods were not apparent.
Transport damages
Obvious damage to the parcel has to be displayed immediately. Later complaints of damage to the package of services are not accepted.
Place of Jurisdiction / Place of Performance
Place of performance is Kirchheim, place of jurisdiction is Besigheim or Heilbronn, only German procedural law applies
